These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you,” “User”) and Irwin Media and Training Inc., doing business as Mind Your Horse (“Company,” “we,” “us,” or “our”), governing your access to and use of:
The Mind Your Horse mobile application
Our online courses, memberships, and community features
Any related services (collectively, the “Services”)
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
1. ELIGIBILITY
You must be at least 18 years of age to use our Services. By using the Services, you represent that you meet this requirement.
2. ACCOUNT REGISTRATION
You may be required to create an account to access certain features.
You agree to:
Provide accurate and complete information
Maintain the confidentiality of your login credentials
Be responsible for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3. INTELLECTUAL PROPERTY
All content within the Services — including videos, training materials, text, graphics, logos, course content, and branding — is owned by or licensed to Irwin Media and Training Inc. and is protected by intellectual property laws.
You are granted a limited, non-transferable, non-exclusive license to access and use the content for personal, non-commercial use only.
You may not:
Copy, reproduce, distribute, or resell content
Share login credentials
Record, download, or redistribute paid course materials
Use content for commercial training or resale
All rights not expressly granted are reserved.
4. MEMBERSHIPS AND PAYMENTS
Certain features require paid access.
By purchasing a course or membership, you agree to:
Pay all applicable fees
Provide accurate billing information
Comply with subscription renewal terms (if applicable)
All payments are processed through third-party payment providers.
We reserve the right to modify pricing with reasonable notice.
5. USER-GENERATED CONTENT
You may upload or post content, including photos, videos, comments, or other materials (“Contributions”) within community areas.
By posting Contributions, you:
Confirm you own or have permission to share the content
Grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute the content within the Services
Understand that content posted in community areas may be visible to other members
You agree not to post content that:
Infringes intellectual property rights
Is defamatory, abusive, or unlawful
Violates privacy rights
Contains harmful or malicious code
We reserve the right to remove any content at our discretion.
You remain responsible for your Contributions.
6. PROHIBITED USE
You agree not to:
Use the Services for unlawful purposes
Interfere with platform security
Attempt to reverse engineer the application
Use automated scraping or bots
Harass or abuse other users
Share access credentials
Violation may result in termination without refund.
7. COMMUNITY CONDUCT
Mind Your Horse values respectful discussion.
You agree to:
Engage respectfully with other members
Avoid harassment or intimidation
Avoid harmful or discriminatory speech
We may suspend or remove users who violate community standards.
8. MOBILE APPLICATION LICENSE
If you access the Services via our mobile application, we grant you a limited, revocable, non-transferable license to use the application for personal use in accordance with these Terms.
You may not:
Reverse engineer the app
Create derivative works
Use the app to compete with us
App distributors (Apple, Google) are third-party beneficiaries of this license.
9. DISCLAIMERS
The Services provide educational information related to horsemanship and training.
We do not guarantee specific outcomes.
You acknowledge that:
Working with horses carries inherent risk
You are responsible for your own safety decisions
Training decisions should be made at your own discretion
The Services are provided “as is” without warranties of any kind.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
Irwin Media and Training Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.
Our total liability to you for any claim shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.
11. INDEMNIFICATION
You agree to indemnify and hold harmless Irwin Media and Training Inc., its directors, employees, and affiliates from any claims arising out of:
Your use of the Services
Your Contributions
Your violation of these Terms
12. TERMINATION
We may suspend or terminate your access at any time for:
Violation of these Terms
Unlawful behavior
Harmful conduct within the community
Upon termination, your right to access the Services ceases immediately.
13. MODIFICATIONS
We may update these Terms at any time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
14. GOVERNING LAW
These Terms are governed by the laws of the Province of Saskatchewan, Canada.
Any disputes shall be resolved exclusively in the courts located in Saskatchewan, Canada.
